Netclub is a service that offers you a choice and a safe and efficient place to meet the ideal partner or make new friends and share your hobbies or passions with them. Profiles posted for any other purpose, e.g. advertising, sexually explicit or discriminatory material, will be refused. Moreover, no profile from minors, professionals or couples, or profiles containing ‘suggestive’ photographs or pictures of celebrities, or profiles otherwise contrary to the spirit of this website will be accepted.
We make every effort to ensure that our members and visitors will enjoy their visit to this website. Thus we would like you to become familiar with your rights and obligations. Article 1 - Acceptance of General Terms and Conditions - Top of page
1.1 To register on this website and subscribe to the dating service offered by Netclub (hereinafter the “Service”) on www.netclub.ca or any of its partner websites (hereinafter the “Netclub Website”), you must necessarily agree to the General Terms and Conditions (hereinafter the “General Terms and Conditions”) set forth in this document. Anyone who subscribes to the Service becomes a member of Netclub (hereinafter the “Member”).
1.2 The General Terms and Conditions may be amended from time to time and at any time. These General Terms and Conditions were amended and updated on March 22, 2006. Any subsequent amendment which affects current subscriptions shall be announced as follows: each Member shall receive an e-mail informing such Member of the changes made to the Service in the month before such amendment comes into force. Each Member shall then be entitled either (i) to accept the new terms and conditions or (ii) cancel his or her subscription to the Service without cost within four months following the date on which such amendment comes into force. If no cancellation is made within such time, the Member shall be deemed to have accepted such amendment.
Article 2 – Undertaking of the Users - Top of page
2.1 Netclub requires every Member to undertake not to use the Service to:
- provide false information about such Member in his or her profile;
- harm anyone in any way whatsoever, and more particularly a minor;
- publish any material which could incite someone to commit a crime or other offence or provoke discrimination, hatred or violence based on race, ethnic origin or nationality or provide false information;
- publish private and personal information regarding adoption, ongoing trials or the suicide of a minor, or information regarding a person’s tax status or information violating anyone's privacy;
- slander or abuse anyone via the website or a profile;
- undermine the authority of the justice system or endanger minors, namely by producing, conveying and publishing material of a violent, pornographic or degrading nature;
- attempt to mislead other users by using someone else’s name, identity, photograph or corporate name;
- post or send any material infringing a patent, trade-mark, trade secret, intellectual property right or other proprietary right of another person;
- post or send unsolicited or unauthorized advertising or promotional material (namely by spamming or any other form of solicitation) or harass one or more users in any way whatsoever;
- collect and store personal data on other users;
- intentionally or unintentionally contravene any national or international law or regulations.
2.2 Netclub considers the above obligations as conditions precedent and, in the event of non-compliance therewith or breach thereof, Netclub shall have the right to (i) delete or withdraw any material deemed in breach of the terms and conditions hereof or otherwise deemed reprehensible; (ii) cancel all or part of the access corresponding to your account and your password at any time, effective immediately, and/or prohibit subsequent access to the Service.
Article 3 – Your registration as a Member - Top of page
3.1 Profiles are limited to one per user on Netclub and its partner websites. Registration is free and you register by posting your profile and confirming your registration by e-mail. Your registration becomes final only upon being validated by our monitoring team.
3.2 Terms and Conditions of Access to Netclub for Women Looking for Men
Once their registration has been validated by our monitoring team, the main features of the service are available to women free of charge. By subscribing to the VIP paying service, women can also enjoy additional features such as instant posting, increased visibility in search results, free responses for their male recipients, elimination of advertising and priority e-mail support.
3.3 Terms and Conditions of Access to Netclub for Men
Once their registration has been validated by our monitoring team, men become “Guest Members”, which provides them only with limited access to Netclub, including the following features:
- Profile: possibility of creating a profile with photo, changing the information in your profile at any time, and certification of your profile;
- Search: quick search, consulting profiles and photographs, receiving selected profiles directly by e-mail (limited features);
- Newsletter: receipt of the Netclub Newsletter;
- Mail: possibility of sending 2 contact messages to Members registered for more than 30 days;
- Profile: modification of the information in your profile.
To enjoy all the features offered by Netclub, male Members have a choice of two types of access:
- GOLD subscription for 7 days or 1, 3, 6 or 12 months with unlimited access;
- SILVER subscription for 1, 3, 6 or 12 months with unlimited access, except for the Chat service.

4.2 Purchasing Policy and Subscription Terms and Conditions
All purchases are final. Before purchasing a subscription, verify your choice of subscription carefully. No refunds or exchanges shall be allowed once a subscription has been purchased, even if our services are not used or a computer failure occurs during your subscription period.
To ensure that our Members benefit from continuous service, subscriptions paid for by credit card or Paypal shall automatically be renewed upon expiry. Members shall be notified thereof on the website upon payment, and by e-mail several days before the renewal date. Members may refuse this option at any time by simply clicking on “My Account”.
Discreet billing under NTCB (except for Paypal).
Expiry of the subscription. The expiry of your subscription does not entail the automatic deletion of your profile as you may remain a Guest Member. To delete your profile permanently, log on to www.netclub.ca or one of the partner websites, go to “My Profile” and click on “Delete my profile and account”.
NB.: deleting your profile is permanent and results in the deletion of your profile, photographs and messages. To access Netclub again, you will be required to register anew and create a new profile.

5.1 Paying Options
Express Validation of Photographs
It requires a processing period of 5 business days to validate and publish photographs in a Member profile.
Netclub offers its Members the option of express validation, which allows photographs in the profile to be processed, validated and published in a shorter period of time:
- where express validation is requested before 10 p.m., the photograph will be published the same day
- where express validation is requested after 10 p.m., the photograph will be published not later than on the following business day.
Express validation of photographs can be subscribed for by telephone for a $2 charge, which shall appear on your telephone bill.
Photograph Scanning Service
Members can publish their photographs by uploading a digitized or scanned photograph onto the service.
To publish the photographs of Members who do not have a digitized version thereof or who cannot scan or upload their photographs to the service, Netclub offers a photograph scanning service. Netclub operates a studio where black and white Member photographs can be scanned, processed and published on the Netclub Website. For this purpose, a Member must mail to our customer service a photograph which the Member wishes to publish in his or her Netclub profile, accompanied by a cheque in the following amounts:
For men, the service costs CAD$20 per photograph scanned.
For women and male VIP Members, the service is free of charge for the first published photograph. Each additional photograph scanned costs CAD$20.
To protect the confidentiality of our Members, all photographs mailed will be systematically destroyed after scanning. Members who wish to keep their photograph or photographs are asked to include a self-addressed stamped envelope to enable our service to return them.
5.2 Free Options
GOlive Service
The GOlive service allows you to receive alerts without having to surf the Net or be connected to the Netclub Website. The GOlive service allows Members to be informed in real time of any action relating to their profile on Netclub:
- New message posted by another Member.
- Log on of a Member on your “hotlist”
- Chat request.
etc…
The GOlive service is accessible by downloading and installing the GOlive application. This application is available free of charge on the Netclub Website.
To install the GOlive application, you are asked to follow the instructions when downloading the application, particularly the warnings regarding the minimum configuration of your computer. In the event of a possible conflict with other software during installation of the GOlive application on the user’s computer, Netclub shall not be liable for consequential damages to the other party. The parties hereby expressly agree that consequential damages shall mean any moral or commercial damages, loss of profit, productivity, sales, clientele, reputation or orders. In all other cases, the liability of Netclub shall be limited to the subscription amount paid by the Member upon registration to the Service.
Certified Profiles
A certified profile is a profile with respect to which a Member has provided Netclub with a copy of his or her ID card (or passport), proof of address and an affidavit of marital status and to the effect that the information in the profile posted on the website is true and accurate. Netclub's certification is limited to verifying that the information in the profile agrees with the information on the documents provided by the user. Verification is made only upon certification of the profile (when the “certified profile” logo is posted on the profile). Members therefore acknowledge that certification does not absolutely guarantee the accuracy and genuineness of the information and further acknowledge that Netclub does not have the means to ascertain the accuracy and sincerity of the information beyond what appears on the copies of the documents requested from the user. Netclub shall not be held liable in the event that such information should prove to be false or inaccurate.
Article 6 - Managing Your Profile and Use of the Service - Top of page
6.1 It’s simple! You read profiles from other Members and, if you are interested in a profile, you can leave that member a message (VIP only). You read messages that other members have sent you (VIP only). You can change or delete your profile at any time.
6.2 The information in your profile is personal information which is protected under our Policy on the Protection of Personal Information (see section 8 below). You undertake to provide accurate and complete information about yourself and to update the same regularly.
6.3 When visiting Netclub, you enter your user ID name and password, which allows you to contact other Members and read their answers (VIP only).
6.4 By annexing your picture to your profile, you agree to its being posted on the website. You also authorize the publication thereof on Netclub partner websites or in Netclub information bulletins intended for Members and when Members send profiles outside the Netclub community.
6.5 By registering, you also agree to receive Netclub internal information bulletins (Newsletter) featuring contests, activities, news and special promotions of the Netclub Website.
Article 7 - Security and Control by Netclub - Top of page
7.1 Protection of Minors. Netclub endeavours to respect the safety and privacy of the users of its website, and more particularly children. Minors are not allowed on the Netclub Website. Parents are urged to monitor their children’s use of Netclub, keeping in mind that the Netclub Website is designed to reach a wide audience. As legal guardians, parents have the responsibility to decide whether or not the website is appropriate for their children and to monitor their children’s use thereof. Your presence on the website implies that you are of legal age, mentally competent and/or are considered to have the legal capacity to use the website.
7.2 We ask you to be on your guard to protect the security of your own password. Your password enables you to gain access to the website for personal use only. Do not make your password easily accessible and avoid disclosing it to third parties.
7.3 It is strictly forbidden to use or communicate the tools at your disposal with a view to cause harm to the security of the website, to manipulate the resources of the system or the right of access to the Internet, to attempt to discover passwords or to hack into or spy on the network.
7.4 Members and visitors of Netclub may be required, upon request, to play an active role in the prevention of computer hacking. If you are personally involved in any such breach of the security system, Netclub may be required to provide the relevant details and circumstances to the authorities and assist them in their investigation and in resolving the problem.
7.5 Netclub monitors some Member activities on Netclub. For this purpose, Netclub has a team of monitors assisted by software programs that automatically detect inappropriate use (mass sending of e-mails, soliciting, exchanges relating to minors and any statements or use which are non-compliant with the undertakings set forth in section 2 above). Netclub provides this monitoring service on its own initiative or as a result of a complaint or comment by another Member.

Article 9 - Proprietary Rights - Top of page
9.1 This website is the property of Netclub. The graphic design and all the content thereof, whether owned by Netclub or by third parties, are protected by trade-marks and copyright and any unauthorized use thereof constitutes an infringement punishable by law.
9.2 On becoming a Member, you agree to grant Netclub a licence to use the information in your profile to provide and promote the Service. Such licence relates to the reproduction, representation, translation and distribution on any medium (press, radio, television, e-mail, Internet) of the content and elements of your profile (information, text, and photo). Such licence is restricted to the term of your registration on the Netclub Website and to the jurisdictions in which Netclub operates. Furthermore, you agree that such licence may be transferred to any successor or assign of Netclub.
9.3 You are authorized to access and use the website and all the content thereof on a simple computer for your own private and non-commercial use only. Moreover, using all or part of this website on another website, a computer network or any other medium is prohibited. It is further strictly prohibited to unlock, reverse engineer, decompile, copy and/or read the code used by the website software for the purpose of examining or copying the same or creating derivatives based in whole or in part on the software used by the website, except to the extent permitted by law. No part of the website may be reproduced, published, copied, recorded, mailed, transmitted, broadcast or distributed in any way whatsoever without the prior express authorization of Netclub, except as permitted by law.
Article 10 - Responsibility of the Member - Top of page
Each Member or visitor is responsible for his or her own actions and dealings with other Members or visitors on the website. Each Member is responsible for the content, information, services or any other element which he or she decides to bring to the attention of the other Members or visitors on the website. Such information is distributed “as is”, without any express or implied warranty of any kind, particularly as regards the accuracy and veracity of the facts or of any content on the website.
Article 11 - Responsibility of Netclub - Top of page
11.1 Every possible effort is being made by Netclub to monitor the messages exchanged between Members. Netclub reserves the right to delete or modify at any time any content which it deems inappropriate (including Member profiles) after notifying the relevant Member (except where a fundamental obligation is breached, in which case prior notice is not required, see section 2.2). In the event of inappropriate content appearing on the website which has escaped Netclub’s notice, Netclub requests you to notify it thereof.
11.2 Despite the procedures described above and owing to the volume of information between Members, control of the content sent by Members over the Service cannot but be limited, and thus Netclub cannot guarantee the veracity or honesty of such content.
11.3 Netclub shall use its best efforts to ensure that the Service is available at all times, without interruption or error and to ensure that the website or the servers that enable the operation of the website online are virus-free and without dysfunction. The Service may be momentarily interrupted for maintenance operations designed to improve or correct the Service, in which case Netclub shall use its best efforts to inform the Members thereof beforehand and to reduce the inconvenience resulting from such interruption.
Article 12 - Warning - Top of page
12.1 Netclub strongly advises never to disclose personal information to other Members, such as your real name, postal or e-mail address, telephone number, which could allow you to be identified offsite. Where such information appears in your personal profile or vocal messages, Netclub reserves the right to delete it without prior warning. In case of a second offence, access to the website could be denied without warning.
12.2 Netclub advises its Members to take every possible precaution when meeting other people for the first time. For example, it is recommended to meet in a public place (a bar, restaurant etc.). We further recommend that you notify a close friend if you decide to meet in a private place.
